HONOLULU – The Honolulu District Attorney will not file a criminal complaint in a fatal street anger case.
“After carefully examining all the evidence in this case, including testimony, we determined that Gerald Waialae, the deceased, was the original and unprovoked aggressor in the traffic incident,” said Attorney Steve Alm that we did not have enough evidence to unequivocally rebut that the suspect acted in self-defense. “
Waialae and another man got into an early morning altercation on a freeway in March. The incident escalated into a physical fight in which Waialae was fatally stabbed.
Witnesses said Waialae was severely drunk and deliberately rammed the other man’s car, Matthew Dvonch, the prosecutor’s special investigator, told the Honolulu Star Advertiser.
“This man incited my husband and my husband was upset because he kept cutting her off on the street and he upset my husband and that’s why he got out of the car. My kids were in the car, â€Waialae’s wife Marilyn told Hawaii News Now. “He was waiting for my husband with this weapon in hand.”
She said that if the man had acted in self-defense, he would not have left the state.
